reagan national falling back into the mid 30s. and the chill continues to work into dulles and bwi marhsall. both reporting freezing temperatures, 32 as you get outside the beltway. one or two sprinkles or light snow flurries. got to look real close there. that along our cold front which is south and east. and the trend will be left over moisture out of here but the clouds as well. we should see a decent amount of sunshine. not expecting any additional shower and/or snow shower activity. should be a nice quiet afternoon. a little chilly. 41 your daytime high. sunny and another cool afternoon for the second day of january. more details on the weather. guess who else is back? julie wright. >> good morning to you, tucker. been busy on the west side of town this morning. earlier accidents along the dulles toll road.

then the crash eastbound 66 before the beltway. that's what's tying up the left shoulder. virginia state police tell me they'll have to off load the bus. on the shoulder for the while. 66 before 123 has been moved over to the shoulder. traffic slowing with the heavier volume eastbound. fair oaks eastbound towards the capitol beltway. we'll show you what else is happening. southbound 270 no issues to report. traffic is heavy on the top stretch passing the 109. outer loop of the beltway below speed. 95 around the georgia avenue from 202 over towards that new york kennel worth avenue split. that's a check of your fox 5 on time traffic. >> the yays are 257. the nays are 167. the motion is adopted. a motion to reconsider is laid on the table. >> there you go. just like that a bill on the so-called

fiscal cliff is passed after it was approved by the house late last night. >> the legislation is waiting for the president's signature. it was temporarily avoid tax hikes and government spending cuts. melanie is live with more now. good morning. >> reporter: good morning, allison. i got to tell you it was a nail biter all day here on capitol hill yesterday. despite the bipartisan approval. definitely not certain. and as the evening wore on, hill watchers were starting to get a little nervous. it was literally the 11th hour when john boehner brought that senate plan up for a vote. it passed 257 to 167. for much of the day republicans argued whether to change the bill by tacking on spending cuts and send it back to the senate. but senate leaders warned that would blow apart the deal. taxes would only go up on americans making

$400,000, couples $450,000. it also extends long-term unemployment benefits and fixes the alternative minimum tax but delays the spending cuts for two months and that is setting up another fiscal crisis. >> no one believes that what we have before us tonight is a long-term solution to this problem. >> problem is we set up three more fiscal cliffs. we're going to have to deal with the debt ceiling, deal with the continuing resolution, expiration and the sequester. and all that's left is spending cuts. we got to look back on this night and regret it. >> in his comments last night, president obama warned republicans he planned to ask for more revenue as part of his promised deficit reduction

measures. republicans said they are going to work hard for cuts to entitlement programs as any part of the agreement to raise the debt limit. on monday, the u.s. did exceed $16.4 trillion debt limit. tim gietner sent a letter saying the treasury department has to start kicking in extraordinary measures and those measures will run out february 28th. >> all right. thank you very much. >> so congress's action means the income tax for most will not go up but you will see another tax hike this year. >> sarah simmons is back with us now to explain that. >> hey, a lot of people might be confused. there is a tax we are talking about and that is the payroll tax. this is the amount that gets taken out of your check to go towards social security. for the past two years it was reduced to 4.2% in order to give you a break.

the fiscal cliff bill passed last night did not include an extension of the payroll tax cut so now the rate goes back up to 6.2%. here's what this means. a household earning 50,000 $50,000 a year will see paychecks cut by $1,000 this year. for workers making as much as $110,000 a year which is the maximum wage subject to the payroll tax that's $2200 less coming home. this could still be a big hit to the economy. with some predicting smaller economic growth. they add it is likely a surprise to many americans who had heard about income tax rates and not the payroll tax. there is some good news to show. the fiscal cliff bill includes a farm provision that prevents milk price from doubling. and cancels a $900 raise congress

was set. and a big head line that taxes taken out of your paycheck will go up. it's the social security payroll tax and not the income tax. so we just want to make sure people know that so they are not caught off guard by this. >> sarah, thank you. kind of. >> you're welcome. >> she's just the bearer of the news. wall street could be in store overnight overseas market registered relief on the first day open. u.s. stock said monday optimistic the house would reach a deal. the dow rose 166 points. naz dag and s&p rose about 2%. we will have much more on the fiscal cliff deal all morning long. chris van hollan joins us live and our team of political strategists join us live for a look at both sides of the debate and the

incoming congressional class. >> meanwhile, new york law makers from both sides left last night furious after john boehner adjourned the house session without holding a vote on aid for super storm sandy. approved a $60 billion relief package on friday and a house committee had drafted a smaller measure. if the house doesn't vote on that before the session ends tomorrow, back to the drawing board when the next congressional class begins later this month. >> a prince william county community gathered last night to honor a police officer killed in the line of duty. chris yung's motorcycle collided with a mini van while responding to a call on new year's eve. both vehicles caught fire. two citizens pulled him from the wreckage but he died in the hospital. no charges have been

new this morning, a celebrity photographer killed in the line of duty. los angeles police say the yet unidentified man was crossing the street taking pictures of justin bieber's ferrari and hit and killed by another car. the pop star's car was parked on the side of the road. the driver of the car that hit the photographer probably will not face charges. >> a rough start to the new year for worshipers at the first wesley church. a two alarm fire caused more than $100,000 of damage to the temple. no one was hurt. and still no word on what sparked that blaze.

>> survivors of the newtown school shooting head back to class tomorrow. but not at sandy hook elementary. officials moved the desks to a nearby town. it's been almost three weeks since the gunman killed 26 students and faculty members. it's important for children to get back to a routine. >> and there's an aerial sweep of a shipwrecked oil rig. shows the craft is not leaking fuel. the drilling barge ran a ground monday but it appears to be stable. carrying 150,000 gallons of fuel. >> didn't know an oil rig could get shipwrecked. >> technically it's a ship. >> i don't know what to call it. >> tanker wreck. >> i don't know. i guess that's appropriate . >> hi, tuck.

games and rgiii have won 10. you are seeing the pistol just like they run here. could be looking at a mere image of each other. and mike shanahan talked about how historic it is to have three great rookie quarterbacks. >> you take a look at 40 years in the national football league and draft round choices that play 10 or more games, and all of a sudden this year there's three guys with winning records. i can't really explain that. but all three quarterbacks playing at a very high level. i think it's great for the game. it speaks highly about the colleges and what they are doing with the passing attacks now to get them more accustom to the nfl. but also a credit to the quarterbacks and how they play. >> what you are seeing there is mobility. and andrew luck, he can run it as well. you got a

big sunday line up. fox 5 playoff special and the national boys takeover at 4:00. and the kick off the big one the redskins taking on the seattle seahawks and if they win, they would play at atlanta or green bay or excuse me minnesota. it gets kind of crazy. just beat seattle and figure out where we go. >> i was going to ask you i know you were at the game but went back and watched it. did you get a different feel? >> to be honest, watching it on tv, cause i recorded it, i felt even more so they handled the cowboys. i thought hall had his best game this year. you know the cowboys are going to get big plays but really handled them. >> what they showed too is limited rgiii. they've proven it's not a one man band. the defense has stepped up. it's a total team effort.

seattle has won 5 in a row. >> can i ask you a quick question? >> yes. >> the fact we're playing a mirror image team, does it make it harder or easier? >> it would be easier in practice. pretty much what they are going to be seeing. when they are going up against rgiii, hey we've seen this before every week. the problem i think for seattle is they don't travel well. dynamic unteam. they don't play well on the road and for whatever reason when west coast teams come to the east coast time slot, it just doesn't seem to add up and the natural grass should slow down rw 1 just a little bit. >> it's the year of the rookie. >> my fear is our rookie isn't 100%. >> no he's not but they've proven -- >> if you have a mirror image on the quarterback -- that's all i'm going to say.

a heads up for drivers. fairs on the dulles toll roads jumped again. as of yesterday, tolls went up 25 cents to $1.75. using the on and off ramps will cost you $1.

the rate hikes will be used to pay for the dulles metro. >> president obama's second inauguration, construction has been underway for several weeks now. by law, the president has to be sworn in on january 20th. that's a sunday so it will take place in a private ceremony. the public events will be held on monday january 21st. people in the dc region are looking to cash in. some are charging up to $4,000 to sublet their homes to tourists. >> still ahead in our next half hour, inside look at the house fiscal cliff vote for one law maker. sit down with maryland law maker. >> 2013 most in demand pregnancy pictures. i have to say i have not been paying attention to the celebrity news. this is news to me. the first pictures of kim karsashian's

notice the movement there out to the south and east. and we're going to be looking at the improving conditions. if you look carefully here out to western virginia, starting to get breaks. we'll see more sunshine build in tonight. a very dry weather pattern the next several days. we're not looking at winter weather. not even rain showers for the next week or so. 41 today becoming sunny, cool. winds north and west at 5 to 10. and clear skies. we do have a meteor shower. partly cloudy conditions. 30 the overnight low. winds north and west at 5. and the 7 day forecast, plenty of sunshine the next couple days. the redskins game, right now we look dry. next tuesday, a warming trend up near 50. let's do traffic. julie wright is back with a big smile on her face.

shifts. that's right. so you got most of this or much of it done. but first, give me your overall impression about how things went yesterday, last night. what it was like in there dealing with all this and having it come not down to the wire but over the wire. >> sure. this has been a roller coaster as the american public has followed this. i'm glad we were able to get it done. bipartisan vote first in the senate and then in the house. and the key was speaker boehner allowing the house to work its will. at the end of the day this passed when a vote to two democrats to every republican supporting it. democrats wanted to move forward on what was clearly a compromise proposal. compromise in the senate and we thought it was important to do the right thing for the country. there are things in here people don't

like. there are things in here i don't like but overall, that's what compromise is all about. >> i want to get to some of the specifics in a moment. since you mentioned speaker boehner. the republicans are divided on this. speaker boehner, paul ryan voted for it. yet people like erik canter voting against it. does that indicate we are going to continue to see problems on getting compromise on the debt ceiling and other issues yet to be resolved? >> i'm very nervous about some of the things our house republican colonel eeks have been saying. what they are suggesting is they are going to threaten what is the full faith and credit of the united states on the debt ceiling in order to try and get their way on other things. would be like one of us saying we're not going to pay our mortgage unless we get something else our way. these are bills the united states has

already incurred. this is about paying the debts of the united states. and when they threaten not to pay its debts, that creates big economic concerns. that's two months down the road. it's a preview. the good news for now is we did avert the fiscal cliff and did it by asking higher income individuals to pay a little bit more to reduce the deficit. but also making sure middle income families would continue to see the tax relief they've had. and that's really important to those families and very important to our economy. >> and i don't want to take anything away from what was accomplished because something did get done particularly when it comes to taxes and middle class families. the payroll tax, that was not dealt with. so that's going to go up from 4.2% to 6.2% now. why was that not dealt with and since it was

allowed to go up, can anything be done retroactively? >> the payroll taxes are now going to go back to what they were two years ago. we provided a payroll tax cut holiday over the last two years because the economy was especially fragile and weak. and that extra money did help the economy rebound. i actually proposed that we phase that out. in other words, right now people have a 2% payroll tax cut. i thought we should go down to 1% and then phase it out over a longer period of time because the economy still is fragile. i wish we could have done it. it was part of the president's proposal he put to republicans. republicans rejected the idea of extending the payroll tax cut. a little bit of an irony since they wanted to continue in full tax cuts for wealthy people but did not want to continue the payroll

tax cut which benefits 160 million americans. but you asked about the republican dynamics in the house. and what was interesting here was a strong majority of the senate said yes. in the house, the overwhelming majority of republicans said no. and it gives you a little glimpse into why we've had such difficult job getting our house colleagues to compromise with us. the senate republican said okay but house republicans said no. >> why do you think that is? >> well, they have had a really difficult time compromising on all sorts of issues. they have a very ideological rigid caucus. what speaker boehner did last night was finally allow the house to work its will. there is this rule called the haster rule which said he won't even allow a vote unless the majority of republicans are for it.

we all said if you abandon that artificial rule, we can get stuff done. and that's what happened. he abandoned the rule that said he'll only allow vote if you have the majority. then you can move the country's business forward. >> sequestration is put off for two months. can something get done regarding sequestration before that time is up? >> i think we can avoid the sequestration continuing beyond the end of february. what i cannot promise is quickly and easily. it's going to require a whole new set of decisions. we don't want to kick the can down the road. in other words, you don't want to lift sequestration and lose the benefit of deficit reduction. it's a bad idea. across the board arbitrary cuts. what we need to do is replace

those cuts with the similar amount of deficit reduction. additional targeted cuts in other areas but also as the president indicated yesterday and the day before additional revenue from closing the other tax loopholes out there. >> we're out of time so i want to get a short answer. this got done last night, 24 hours late but it got done. is congress dysfunctional? >> well, it's a very bumpy messy process. unless the speaker allows votes to happen like he did last night where he doesn't establish this rule that you have to have the majority of republicans in favor of something in the house, then it is going to be really hard to move forward with the people's business. but if the speaker does going forward, what he allowed to happen last night is just allow.

it's not the republicans house or the democrats house. let the house vote. more republicans voting for something and fewer democrats. sometimes like last night, two democrats to every republicans voting for it. but the problem is the house republicans and this has been stated by nonpartisan. the house republicans are unwilling to compromise. a lot think compromise is a dirty word. they go back to districts and say they want things 100% their way. when you have divided government, one in control of congress, the only thing that stands in the way of divided government and dysfunctional government is a willingness to compromise. and that has been in short supply and we saw that. >> certainly among some house republicans. >> we saw majority of senate republicans support this. we saw majority oppose this compromise. the good news is yesterday we avoided the fiscal

cliff. i hope that will be a model. in terms of being able to get things done for the good of the country. it's got stuff in there that some people like including good things but also things many of us don't like. >> i do want to mention we did reach out to several republican representatives and weren't able to get any of them to come on. >> hopefully what we can agree on is the redskins are going to win. we're going to have a big game. >> i'm with you on that. thanks for coming in . good to see you. it's 7:42. we'll be right back .

well, just when you made that new year's resolution to drop the extra rate, a new study might give you reason to leave that weight on. being slightly over weight may actually help you live longer. comparing body mass index to the risk of death. people with a little extra weight and 6% -- had 6% lower risk of dying more than people in the normal weight range. that's not an excuse to pack on

the pounds. people considered obese had more than triple risk of dying. very confusing. just be healthy. >> don't we all have the same risk of dying? >> you know what, my husband has always said, when you see that person who does live a really long time, sadly, not sadly. they tend to be on the thinner side. so i don't understand what that study means. just be healthy. >> yes, be healthy. >> we got cold temperatures to start your day. cold front coming through. that's been responsible for a couple sprinkles or snow showers along with colder temperatures along the way. we're just starting to see that move in as we speak. 35 in washington. new york city 22 this morning. 10 in columbus. 8 in detroit. >> binghamton, 12.

what you are putting into your body. good morning, happy new year and good to see you. >> reporter: happy new year. great to see you all. didn't we have a story we need to be more over weight if we want to live longer? >> kind of confusing. >> okay. this is the way i look at it. you need to look the way you want to look and chances are if you choose to live healthy, it will extend your life. she's the nutritionist here. happy new year to you. >> happy new year. >> everybody no matter what, we can all be a little more healthy. and that's the real goal, right? >> yeah, absolutely. even if you are eating healthy food, portion size becomes important. i have tools up here to talk about portion size. >> we're not going to play softball or tennis. >> we're not taking shots. >> tell me what you want to show with these. >> basically by rule of thumb

what i tell people is to use your hand. when you are looking at a plate, this is based off of the usda my plate. it's a great teaching tool. because if you are looking at how to structure your meals, it shows you a lot better than the old pyramid. if you are looking at a plate, i have a styrofoam over there. half of what you are eating to be vegetables. anything other than peas, corn and potatoes. >> and you want color. >> looks a lot prettier. so then a quarter is your protein and a quarter is your starch. so i wanted to show it's going to be in the starch category. if you are looking at say we have rice. if you have a cup of rice it's 250 calories versus a cup of broccoli is 30 calories.

in february, congress will have to decide on raising the country's borrowing limit. another hot button issue, the payroll tax. this is the money you pay towards social security. the rate will go back up to 6.2% up from 4.2%. that means the average household earning $50,000 a year will see $1,000 less in their paychecks each year. and $110,000 a year they will see $2200 less each year. that could trigger a slower growth period for the u.s. economy. >> for more on the back and forth that led to the final compromise and what's in store for the next congress, we turn to democrat strategist peter fenn. good to see you. and republican strategist jordan liebermann. happy new year to you. let's start with where we are today. peter, let me ask you what kind of fight was this

in the wee hours to get this thing passed? >> it's a pretty tough fight allison and a lot of people thought once erik canter said he was opposed to it that they had this old haster rule, chris referred to it earlier. i'm not going to bring stuff up unless i have a majority of my caucus supporting it. if he'd stuck to that this would not have been brought up. or put a poison pill into that thing. so there was a period i think in the afternoon where folks thought this thing might go up in flames. but thank goodness prevailed a speaker. did something that was quite courageous. pretty tough to make the call to just have an up or down vote on it. >> it was courageous. it was courageous for speaker boehner. the problem with this is it was catastrophic for the republican

party from a policy point of view and from a forward looking point of view. we're going to have to do this all over again and have a fight we don't want to fight. the caucus is split. the speaker on the minority. it was a pretty bad night for republicans. it's been a bad week. >> more about congressman. but i have to ask you for the average american person, the voter, the person who is going to feel it after all the political drama has died down, does john boehner look like he lost out? >> no. to the average voter he probably did the right thing. we raise taxes on the rich and that's part of the deal. the other part about cutting $1.2 trillion, nothing. a great short-term fix. democrat party looks nice. we really didn't do much to fix the big problem. >> let's talk about that.

what are we facing ? we're facing it quickly. the next round of all this. >> you know, allison, this is rolling cliff. we're going to see these rolling cliffs, rolling thunder. >> we prefer rolling thunder to this anyway. >> but the hope obviously is that there's a process in place now. i think that you are going to see now serious discussions about entitlements and what has to be done for entitlement reform. both sides recognize that. there's all this talk about tax reform. they didn't deal with that. they are going to deal with ways to get additional revenue from tax reform and other cuts they can do within the federal budget. the hope is we get to a grand bargain but it will be in stages. that's the hope. the scary thing is

the republicans didn't do themselves any favors this time. and i don't think they did themselves any favors when they were trying to deal with the debt ceiling issue. cost $18 billion for that charade a year and a half ago which led to this. hopefully cooler heads will prevail and won't bring it up to the edge and say we're going to vote against the debt ceiling. >> the rolling cliff, the debt ceiling conversation and the sequester. these are huge things. we will all be watching this again. >> right. we'll have the next congress to deal with. the major cuts. the ball is on the democrat side. i don't think they have the courage to make the cut. >> how does that play? we do have this transition here. how will this play out? >> you have a few more democrat senators. two more than last night. a little different make up in the house. but jordan is right. i have to say, the

democrats have got to -- and they did on this one take on the most liberal parts of their party. to take on a lot more when it comes to some of these things. they are not popular and not easy. the reason everybody pushes the can down the road is because this is hard. a lot was done with this legislation. we dealt with the inheritance tax on this. everybody knew a two year tax holiday temporary holiday. you give people $1,000 and then tell them it's over, that isn't easy. >> i disagree, we did the easiest thing. we raised taxes on the rich. great. let's try cutting benefit s to the poor. let's see what happens when we roll back social security cuts. >> there will be a lot of tough things. >> and hopefully you will be here to help us get through all of this. thank you so much. happy new year to you . tony, back over to you. >> thank you very much, allison.

a prince william county community gathered last night to honor a police officer killed in the line of duty. chris yung's motorcycle collided with a mini van while responding to a call on new year's eve. both vehicles caught fire.

it's 8:46. global markets welcomed the fiscal deal. u.s. markets will open in a little less than an hour. how the new changes will affect americans and investors. good morning thanks for coming in. >> thank you. >> there's a deal on the fiscal cliff. some things were not dealt with but overall, they've dealt with the tax issue. what we now know is that taxes will go up on individuals making more than $400,000 or combined incomes of $450,000. as it relates to ordinary people like you and me. >> everybody is going to know tax rates are going to go up. >> period. >> period, for everyone. some certainly more dramatically than others. but some people are clearly going to pay more taxes. >> for those just tuning in and hearing that. wait a minute i

thought they averted that. there are certain things that kick in. we talked about the payroll tax. >> we had a two year hiatus where they saved 2% of our gross. that's going to go back to what it was normally. the normal rate. one of the bigger changes is we were moving capitol gains rates from 15% to 20 depending on income levels. and then there's affects that are going to take place as it relates to qualified plans. >> let's talk about capitol gains first. that's a significant percentage. 5%. >> 5% is a big deal when you were paying 15 before. at 20% people know what to expect. >> and so what if we know what to expect, what can we do with that information now? >> for those people selling businesses they've had for a long time, you know what the rate is going to be on the sale of that business. we know if we

have assets appreciated over years, we know what rate we're going to pay. at least we have some basis to work from. >> let's talk about the 401 ks that type of thing. >> one of the things the government has done is we're looking around and saying how do we make money? we know there's a tremendous amount of money, 2 to 3 trillion sitting in qualified plans today. what they are going to allow you to do is take that money out with no limitations, roll it over to a roth. what the government is looking at is there's all this imbedded tax money they are going to be able to raise. people need to be cautious about walking into this. >> tell me a little about overall. obviously, there's been a lot of nervousness about all of this. there's still issues yet to be resolved. the whole is he questions strags thing has been kicked down the

road for a couple months. overall, should the markets respond favorably and overall do we have some things that have been dealt with at this point? does that make people like you a little more optimistic in terms of now we know where we're going. >> first of all, it does give us confidence that congress can do something slowly. any time you have any -- any time the congress will make a decision and you know what you are dealing with, positively or negatively, at least you know what you are dealing with. and businesses will tend to spend more. they'll hire. so we're cautiously optimistic . >> one thing i have not read much about, the alternative minimum tax. where do we can't on that at this point? >> the amt, they are going to extend that piece as well. and they need to because there are

to stay on track. and she joins us live in northwest dc. good morning. >> reporter: good morning. this is the year . 2013 is your year. you are going to stick to it and enjoy doing it because if people like lisa. she is the head of all the personal trainers. there's five locations. happy new year to you. how much do you see your membership increase? i think it doubles. >> how long does that last? >> the first three months. >> the people in march their chances of being successful is good. right now your goal make it to march. give me an exercise that's good for all of us to do. >> simple. drop back lunch. you are just going to step back and come back together. alternate. >> as we do this, let's talk about some of the trends for

this year. >> in the top trends, body weight exercises. strength training. functional fitness and core training. >> okay. how many lunches do you think we did? >> about 16. >> it's all about distraction. before you know it you've done a lot of exercises. let's move on. >> something that's fun that you can continue to do for the lower body, lateral lunge and go in the opposite direction. >> let's elaborate. when you say body weight exercises, that means you don't need a lot of equipment. just your own body weight. why does that work so well? >> well, you need to learn how to move your own body around in space. and it increases your strength as you move your own body weight around. >> now, how long before people were doing basic exercises, how long before they really see

results? >> you've got to give it a good 6 to 12 weeks. >> so you need to be patient and consistent. >> and most people give up way too soon. >> what's another exercise? >> very functional, helps with flexibility. upper body strength. you are going to walk up. if you are able, give me a pushup. and walk back up. >> you don't have to be a member of a gym. you can do them in a hotel room. >> absolutely. >> she has said one more. let's do another one . >> we're going to walk back out and get into a plank position. is the trend making sure you work on your core? >> absolutely. >> and why is that?

>> drop down. every move begins in your core. it's important. and you can switch hands. important we have a strong core. your core connects your hips and your shoulders. >> the number one trend which is good for you is personal training. why do you think personal training is such a big deal for people? >> people don't have a lot of time. they want the best thing they can do with the time they have allotted. so personal training will help them be much more affective and fast. >> i learned how to be affective and fast and learned what this hole was about. now i look cool when i workout. one last exercise before we go. >> we have a balance exercise. great for the hip
